MILAN – Green light for the remote control on workers through mobile phones, PCs and tablets, infuriating the CGIL. He put it down on paper the government in the implementation decree of the Jobs Act, approved by the government on June 11th, which – in fact – delete Article 4 of the Statute of workers on remote controls, “union agreement or ministerial approval – reads the text – no need for assigning workers the tools used to make work performance, although the same is derived also the possibility of remote control of the worker. “ The rules in force, however, is “banned the use of audiovisual equipment and other equipment for the purpose of remote monitoring of workers”, while they can be installed “systems and control equipment that are required by organizational needs and that the productive work safety but from which derives the possibility of remote monitoring of workers “only after an agreement with the trade unions. Now the executive leaves white paper companies for the use of the tools companies and it makes it possible to install audio and video after a union agreement or authorization from the Ministry of Labour (for companies with more units located in one or more regions). To explain specifically what’s new It is the explanatory memorandum accompanying the text of the legislative decree in which reference is “the means used by the worker to operationalize the work performance and tools to access logging and presence” to control which does not serve green light. In fact – is the reasoning of the government – “we do not have to ask permission to the representatives of workers to equip them with tools”, these, too, can then be used to control their efficiency. The resulting data can be “used for all purposes related to the employment relationship, provided that the employee is given adequate information about how to use the instruments and the performance of controls, always, however, in accordance with the Privacy Code” . And the guarantor of privacy refers to the Cgil that attacks: “On remote controls are the coup.” “The novelty of the Jobs Act – says the national secretary Serena Sorrentino – raise a point of retreat heavy” compared to the Workers’ Statute. “Not only we will battle in Parliament”, but adds: “We will test the data protection commissioner if it can allow”.
